Info Service on Intellectual Property Issues (Nov14/08) Dear All, Please find attached a submission by the Third World Network to the WIPO Committee on Patents on Patent Related Impediments to Technology Transfer. The submission responds to a request by the WIPO Secretariat for practical examples and experiences on patent - related incentives and impediments to the transfer of technology pursuant to the decision of the 20th session of the WIPO Standing Committee on the Law of Patents (SCP). Excerpts from this submission has been reflected on SCP documentation concerning technology transfer. This submission focuses on cases and experiences where patents are a barrier to technology transfer with the right holder adding a price premium and increasing the price of accessing/using the technology; imposing unreasonable conditions for use of the protected technologies or simply refusing to license out of for fear of competition from the licensee.
